Legal Concerns
When providing an elder care assessment, the elder care manager with CareManaged of Tampa, Florida can assist the client in determining what legal documents may be needed and when a referral to an elder law attorney is needed.
Advanced directives may be needed to implement an effective elder care plan.
Advance directives include:
- Durable Powers of Attorney for Property,
- Health Care Surrogate Designations,
- Directives to Physicians,
- Advance Directives for Mental Health matters and,
- Living Wills.
A Durable Power of Attorney is a powerful document that grants authority from one person (the principal) to another person (the attorney-in-fact or agent)
The Health Care Surrogate, which the elderly person selects, can make necessary decisions concerning all medical matters when the elderly person is unable to do so. If there is no Health Care Surrogate when one is needed, the hospital can appoint a Health Care Proxy or the court can appoint a guardian. It is in the elderly individual's best interest to prepare ahead of time with a Health Care Surrogate of his or her own choosing.
Directives to physicians may include a Living Will and a Do Not Resuscitate Order (DNRO)
A Living Will expresses to the doctors and others a person's wishes regarding the use of life-sustaining medical procedures.
A Do Not Resuscitate Order (DNRO) is a physician's order that is followed by medical personnel. A person cannot create their own order.
